Simply put, universities and colleges receiving federal financial assistance must investigate sexual assault and misconduct complaints made by students. The complaining student is called the “Reporting Party” and the accused student is called the “Respondent”. The schools are required to engage in extensive and comprehensive investigations. They interview the accused, collect statements from any witnesses, gather evidence, and provide the accused student with a hearing before a neutral party. A Title IX judgement of guilt can lead to expulsion from the school and have ruinous consequences to the student’s future career and livelihood.
